Look Beyond the Words
In Francis Collaie Muin V Union Territory of India, the Supreme Court held that
“Article 21 incorporates the right to live with human dignity and all that accompanies it ........ and is a standout amongst the most fundamental component of the right to life which perceives the independence of a person”
“Article 21 incorporates the right to live with human dignity and all that accompanies it ........ and is a standout amongst the most fundamental component of the right to life which perceives the independence of a person”
The judicial interpretation of the constitution by the Supreme Court of India has extended to include into our fundamental rights, things which extend far beyond the written word of the constitution.
In multiple cases such as Unni Krishnan v. State of Andhra Pradesh, D.F. Marion v. Minnie Davis, Smt. Kiran Bedi v. Committee of Inquiry, Maneka Gandhi v. UoI, the supreme court has extended the rights to Reputation, Go Abroad, against Handcuffing, Shelter, Good Environment, Safe Water etc to all as Fundamental Rights, none of which are written anywhere in the text of the Constitution of India
It would be too primitive an understanding to limit the constitution to the written word.
